Welcome, and thank you for choosing Janet Howard Studio ("we," "us," "our"). These Terms of Service ("Terms") govern your use of JanetHowardStudio.com and the photography services we provide. Please read them carefully.

Acceptance of These Terms

By accessing or using this website, booking a session, or purchasing products from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the site or our services. For booked sessions, these Terms supplement — and are read together with — any separate session agreement or contract you sign with us; if there is a conflict, the signed agreement controls.

Using This Website

You may use this site for your own personal, non-commercial purposes. You agree not to misuse the site, attempt to disrupt it, copy or republish its content, or use it in violation of any law. All content on this site — including photographs, text, logos, and design — is owned by Janet Howard Studio or its licensors and is protected by copyright and other laws. Galleries and links we share with you are for your personal use and may be password-protected; please don't share access more broadly than intended.

Bookings, Sessions & Payments

  • Booking & retainer. A session is reserved only once any required agreement is signed and a non-refundable retainer is paid. The retainer reserves your date/time and is applied to your total.
  • Balance & payment. The remaining balance is due in accordance with your contracted due date, usually on the session date. We accept credit cards; online payments are processed securely by our payment provider (Stripe), and we don't store your full card details.
  • Products & print orders. Prints and products ordered through our store are custom, made-to-order items produced just for you.
  • Taxes. Prices may be subject to applicable sales tax.
  • Late payment. Galleries, downloads, or product orders may be held until payment is received in full.

Image & Content Rights

  • Copyright. We retain the copyright to all images we create. You are granted a personal-use license to view, download, print, and share your images for personal (non-commercial) purposes once your balance is paid in full.
  • No alterations. Please don't edit, filter, crop, or otherwise alter delivered images, or remove any watermark, without our written permission. Commercial use requires a separate written license.
  • Portfolio & marketing (model release). Unless you notify us in writing before your session, you grant Janet Howard Studio the right to use images from your session for our portfolio, website, social media, and promotional materials. Let us know if you'd prefer we keep your images private.
  • Your content. Anything you submit to us (messages, form details, materials) remains yours, but you grant us permission to use it as needed to provide our services.

Cancellations & Rescheduling

  • Retainers are non-refundable. Because reserving your date means turning away other work, retainers/deposits are not refundable.
  • Rescheduling. If you need to reschedule, please give us at least 2 notice; we'll do our best to accommodate one reschedule, subject to availability.
  • Late arrival / no-show. Sessions begin at the scheduled time; late arrivals may shorten your session, and no-shows may forfeit money paid for that session.
  • Our cancellation. In the rare event we must cancel (e.g., illness or emergency), we'll offer to reschedule or provide a refund of amounts paid for the undelivered session.
  • Weather. For outdoor sessions affected by weather, we'll work with you to reschedule at no additional retainer.

Disclaimers & Limitation of Liability

Our services are provided on an "as is" basis, and photography is a subjective art — while we bring professional care and a consistent style, we don't guarantee specific results, and editing and image selection are made at our artistic discretion. To the fullest extent permitted by law, Janet Howard Studio is not liable for indirect, incidental, or consequential damages, and our total liability arising from your session or these Terms will not exceed the total amount you paid us for that session. We are not responsible for events beyond our reasonable control ("force majeure"), including illness, accidents, equipment failure, data loss, venue restrictions, or acts of nature. We recommend you back up delivered files; we archive galleries only for 6 months and are not responsible for loss after that period.

Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute will be handled in the courts located in DeKalb County, Georgia and you agree to that jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version, and changes take effect when posted. Your continued use of the site or our services after changes are posted means you accept the updated Terms.
